Consumer Health Data Privacy Policy

This policy is published pursuant to the Washington My Health My Data Act (RCW 19.373) and is separate and distinct from The Signary's general Privacy Policy.
1. Who This Policy Applies To
This policy applies to any individual whose consumer health data is collected or processed by The Signary in connection with our Remote Online Notary (RON) services. Because The Signary is based in and conducts business in Washington State, our obligations under the Washington My Health My Data Act (RCW 19.373) apply to our operations regardless of where our clients are located. Washington State residents have specific enforceable rights under this Act, as described in Section 8.
2. What Is Consumer Health Data
Under the Washington My Health My Data Act, "consumer health data" includes personal information that identifies or is reasonably linkable to a consumer and that a business collects in connection with the consumer's physical or mental health condition, healthcare, or healthcare-related documents.
In the context of The Signary's services, consumer health data includes information contained in or derived from documents such as:
Advance Healthcare Directives (Living Wills)
Durable Powers of Attorney for Healthcare
Other documents containing health-related information presented for notarization
3. Categories of Consumer Health Data We Collect
The Signary collects the following categories of consumer health data solely as necessary to provide notarization services:
The document(s) presented for notarization, which may contain health-related information
The identity of the signer(s) and, where applicable, their designated agent or attorney-in-fact
The audio-visual recording of the notarization session, as required by Washington State law
We do not collect consumer health data from any source other than the signer directly, in connection with a scheduled notarization appointment.
4. How We Use Consumer Health Data
We use consumer health data solely for the following purposes:
To perform the notarization services you have requested
To comply with Washington State notarial record-keeping requirements (RCW 42.45), which mandate retention of audio-visual recordings, notarial journal entries, and document records for a minimum of ten (10) years
We do not use consumer health data for any commercial purpose, advertising, marketing, profiling, or any purpose beyond what is necessary to complete your notarization and fulfill our legal obligations.
5. How We Share Consumer Health Data
We share consumer health data only as follows:
With the signer — the completed notarized document is returned to the signer who requested the service
With the signer's designated attorney — where the signer has identified and directed us to share with their legal representative
With legal or regulatory authorities — only if required by law, valid court order, or lawful government process
We do not sell consumer health data. We do not share consumer health data with any third party for advertising, marketing, or any commercial purpose. We do not share consumer health data with data brokers.
6. Third-Party Processors
To deliver our services, we work with the following service providers who may process consumer health data strictly on our behalf and under our direction:
Pactima — our secure remote online notary platform, which hosts the audio-visual session and stores the notarized document and recording. Pactima processes data as a service provider and is contractually prohibited from using your data for any purpose beyond providing the platform service.
Google Workspace (Google LLC) — used for secure internal communications and record management.
These processors do not have permission to use your consumer health data for their own purposes.
7. Data Security
We implement and maintain reasonable security measures appropriate to the nature of the consumer health data we process, including:
Use of encrypted, password-protected, and professionally hosted platforms
Encrypted data transmission (HTTPS)
Access to consumer health data limited to authorized personnel only
Secure, platform-hosted storage for notarial records in accordance with Washington State retention requirements
8. Your Rights Under the Washington My Health My Data Act
As a Washington State resident, you have the following rights regarding your consumer health data:
Right to confirm and access. You may request confirmation of whether we hold consumer health data about you and obtain a copy of that data.
Right to withdraw consent. Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal.
Right to deletion. You may request deletion of your consumer health data. Note that we are legally required to retain notarial records — including audio-visual recordings and journal entries — for a minimum of ten (10) years under Washington State law (RCW 42.45). This legal obligation limits our ability to delete certain records during the required retention period, regardless of a deletion request.
Right to non-retaliation. We will not discriminate against you or deny you services for exercising any of the rights described in this policy.
9. How to Exercise Your Rights

We will respond to verified requests within thirty (30) days. We may need to verify your identity before processing a request.
10. No Sale of Consumer Health Data
The Signary does not sell consumer health data. We do not exchange consumer health data for monetary or other valuable consideration with any third party.
11. Changes to This Policy
We may update this policy to reflect changes in our practices or applicable law. We will post updates here with a revised "Last Updated" date. This policy may not be combined with other notices or contain information beyond what is required under the Washington My Health My Data Act.
