## 1. Agreement to These Terms
By submitting our intake form, booking an appointment, or using any service provided by The Signary, you agree to these Terms of Service. Please read them before booking. If you do not agree, do not proceed with scheduling.

## 2. What We Do — and What We Don't
The Signary provides Remote Online Notary (RON) services. Our role is to:
- Verify the identity of signers using approved identification methods
- Witness the signing of documents via live audio-visual session
- Apply our notarial seal and signature to documents in accordance with Washington State law
Our role is limited to notarization. We do not provide legal advice, review documents for accuracy or legal effect, verify the truth of the contents of any document, or confirm that a document is appropriate for your intended purpose. If you have questions about whether a document is legally sufficient for your needs, consult a licensed attorney before booking.

## 3. Your Responsibilities
By booking an appointment with The Signary, you represent and agree that:
Documents are genuine. All documents submitted for notarization are authentic and, to the best of your knowledge, accurate. You understand that presenting fraudulent documents for notarization is a criminal offense under Washington State and federal law, and that The Signary bears no liability for notarizing documents later found to contain false or fraudulent information, provided we acted in good faith.
You have valid identification. All signers will have government-issued photo identification available and ready at the time of the appointment, as required by Washington State law for remote online notarization.
Your technology is ready. You are responsible for having a working device with a camera, microphone, and stable internet connection at the time of your appointment. The Signary is not responsible for appointment failures caused by insufficient technology on the client's end.
You are the intended signer (or authorized to act). You confirm that all parties appearing in the session are who they represent themselves to be, and that you have authority to execute the documents presented.

## 4. Cancellations and No-Shows
We understand schedules change. Our policy is designed to be fair to both parties.
Cancellations with notice: You may cancel or reschedule your appointment without penalty provided you give at least 3 hours' advance notice before your scheduled appointment time. To cancel or reschedule, contact us at info@thesignary.com or through your Calendly booking confirmation.
Late cancellations: Cancellations made with less than 3 hours' notice may result in forfeiture of any prepaid session fee, at our discretion. We will make reasonable efforts to accommodate rescheduling in these situations.
No-shows: If you do not appear for your scheduled appointment and do not contact us, we will make one attempt to reach you to reschedule. If we are unable to reschedule your appointment, a $75 missed appointment fee will be applied. This fee reflects the time reserved exclusively for your session.

## 5. Session Failures and Refunds
Remote notarization depends on technology and cooperation from all parties. We take the following approach when sessions do not complete as planned:
Technical failures (platform or our side): If a session cannot be completed due to a technical issue with our platform (Pactima), our equipment, or our internet connection, we will reschedule your appointment at no additional charge and, where necessary, create a new session at no cost to you.
Technical failures (client side): If a session cannot be completed because of issues with your device, camera, microphone, or internet connection, we will make reasonable efforts to reschedule. A new appointment fee may apply if a new session must be created on the notary platform.
Client-initiated discontinuation: If you choose to end a session before it is completed for any reason, you will not be charged for that incomplete session. You are welcome to reschedule, at which point standard appointment fees apply.
Document issues discovered mid-session: If a session cannot be completed because a document was uploaded incorrectly, is the wrong version, or is otherwise unsuitable for notarization upon review, we will work with you to reschedule once the correct document is ready. A new appointment fee may apply.

## 6. Third-Party Platforms
Our services depend on third-party platforms including Pactima (notary sessions), Calendly (scheduling), and Google Workspace (communications). While we select and maintain these tools carefully, The Signary is not responsible for outages, errors, data handling, or service interruptions caused by these platforms. Each platform operates under its own Terms of Service and Privacy Policy.

## 7. Record Retention
In accordance with Washington State law, The Signary retains an audio-visual recording of each completed notarization session, a notarial journal entry, and a copy of the notarized document for a minimum of 10 years. These records are maintained securely and are not shared except as required by law or court order. By proceeding with a notarization session, you consent to this recording and retention as required by law.

## 8. Limitation of Liability
To the fullest extent permitted by applicable law:
The Signary's liability for any claim arising from our services is limited to the fee paid for the specific appointment in question. We are not liable for indirect, incidental, or consequential damages, including but not limited to: rejected documents, legal outcomes, third-party platform failures, or losses arising from document errors that were not caused by our notarial act.
Nothing in these Terms limits our liability for gross negligence or willful misconduct.

## 9. Governing Law
These Terms are governed by the laws of the State of Washington. Any disputes arising from your use of our services shall be subject to the jurisdiction of the courts of Clark County, Washington.

## 10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of our services after any change constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify existing clients.
